Any use by you of our website (lkbennett.com) and/or purchase of products through our website is conditional on (a) your acceptance of these Terms & Conditions and (b) your reading and understanding of our Privacy Policy. We may update these Terms & Conditions and our Privacy Policy from time to time without letting you know and therefore it is up to you to check this page and the associated links contained within it for any changes and print a copy for your records. Your continued use of our website means that you have accepted these Terms & Conditions and have read and understand the Privacy Policy.

These Terms & Conditions set out your legal rights and responsibilities, our legal rights and responsibilities and key information required by law.

1. Eligibility: All subscribers, both new and existing, who are signed up for our email marketing will automatically be entered into a monthly draw to win a £500 Gift Card.
2. Winner Notification: The winner will be notified via email by the LK Bennett Customer Care team each month.
3. Confirmation: The selected winner must confirm acceptance of the Gift Card within 10 days of the notification email. If confirmation is not received within this timeframe, a new winner will be chosen, and the previous winner will forfeit their prize.
4. Geographic Restrictions: This competition is open only to subscribers located in the UK.
5. Gift Card Details:
   a. The Gift Card will be issued in GBP and can only be used on our UK website (lkbennett.com) with a valid UK delivery address.
   b. Gift Cards are not valid for purchases with our concession partners.
   c. The Gift Card is valid for two years from the date of issue. Each time the Gift Card is used, the validity will automatically extend by an additional two years from the date of that transaction.
6. Non-Cash Exchange: Gift Cards cannot be exchanged for cash or other forms of payment.
7. Return Policies: All standard return policies and terms and conditions apply to purchases made with the Gift Card.

These terms refer to our partnership with Thrift+, a resale service for your best second-hand clothes, that allows you to donate your unwanted clothes to raise valuable funds for charities. Customers can get their free* ThriftBag with any purchase online at www.lkbennett.com and in-store with any purchase. For further information, please see here. Customers can sign up to receive notifications for out-of-stock items in specific sizes, without subscribing to marketing emails. Signing up does not reserve stock for the customer. They will receive up to two notifications: one if the product becomes available and a second reminder if no purchase is made. Their data will be removed if the item remains unavailable for three months, they purchase the item, or after receiving two notifications without purchasing. Guest users cannot cancel notifications until one of these conditions is met. While LK Bennett account holders can cancel the subscription at any time by cancelling the notification on the chosen product page.

The website and all text, images, information, photographs contained within it, are owned by or licensed to LK Bennett. The copyright and all other intellectual property rights in the content contained on the website are the sole and exclusive property of LK Bennett.

The contents of the website and the website as a whole are intended solely for personal, non-commercial use. You may view the website and print its contents for this purpose only. You may use your LK Bennett gift card to make purchases at any LK Bennett participating store in the UK (excluding concessions) and on lkbennett.com. LK Bennett e-cards can only be used on lkbennett.com. You can reload and check the balance on your gift card at any time in participating stores or on our gift card page at lkbennett.com. When you use your LK Bennett gift card, the amount of your purchase (including VAT) will be deducted from the balance on the card. Each time you reload your LK Bennett gift card you must add a minimum of £10. Your gift card will automatically expire if it is not used for 24 consecutive months (at which point your balance will be forfeited). Gift cards presented after expiry will be treated as void. Your LK Bennett gift card cannot be exchanged for cash or re-sold. Refunds will not be given for the purchase of a LK Bennett gift card. Lost, stolen, or damaged cards cannot be replaced. All refunds of goods or services purchased with your LK Bennett gift card will be made in accordance with LK Bennett refund policy. This does not affect your statutory rights. LK Bennett will cancel the value of your gift card if we fail to receive payment from the purchaser’s bank or card company for the initial purchase of the card. Further action may be taken where the fraudulent use of a credit card is suspected. LK Bennett reserves the right to amend these terms & conditions from time to time, where we consider it reasonable and necessary to do so. The terms do not affect your statutory rights or gift cards issued prior to the date of such amendments. The advertising of products on this website is an "invitation to treat". You will indicate by completing the appropriate order form on the website the products that you wish to order. At the same time you will complete an authorisation for us to recover, through your credit or debit card, payments due to us. LK Bennett must receive payment in full for your order before it can be accepted. This means that your order is an offer, not a contract of sale between you and LK Bennett, so prices and stock availability won’t be contractually confirmed until you receive the "confirmation of despatch" email which is sent out once credit card authorisation has been confirmed and stock levels have been checked. In exceptional circumstances, if we are not able to fulfil an order we have accepted or if we cancel an order (for example: the item not being in stock or if we cannot make delivery to your address) then if payment has been taken from you, your credit card will be refunded with the original price and in no circumstances will we be liable to you for any additional amounts. LK Bennett reserves the right to refuse to supply any person for whatever reason.

Except for any legal responsibility that LK Bennett cannot exclude by law (including for death or personal injury caused by LK Bennett’s negligence and fraud), LK Bennett’s total liability for any claim howsoever arising shall not exceed the price of the products supplied by LK Bennett to the customer, together with any postage costs incurred. LK Bennett will not be legally responsible for any losses that were not foreseeable when the contract between us was formed or were not caused by any breach on our part.

The price of the products shown on our website does not include delivery (if applicable). Please visit our delivery information page on our website before you place your order to access information about the postage and packaging of products to the UK, ROI & Channel Islands and international delivery. This information also includes details on associated costs, methods of delivery, estimated timeframe and any specific exclusions relating to individual items or delivery restrictions on certain items dependant on the country of export. We may deliver your products in instalments. Your confirmation email will contain the estimated date of delivery.

Delivery will be made to the UK or international address or store specified in your order. All risk in the products you order (including risk of loss and/or damage to the products) shall pass to you when they are delivered to the delivery address specified in your order. LK Bennett is not responsible for any delay or failure to deliver products if the delay or failure is wholly or partly caused by circumstances beyond our control.

Delivery charge refunds are made in accordance with the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013 and other applicable UK consumer legislation. For further information about your rights see the "Your Right to Cancel (Online)" section below.

For international deliveries outside of EU and US, products are sold on a delivery duty unpaid basis. This means that the recipient will be liable for any local sales taxes, import duties or customs fees which may be charged on the purchase.

Where applicable, it is your responsibility to comply with any export controls, sanctions, rules or other restrictions applicable to products supplied to you.

While every care is taken to ensure that all information on this website is correct, there may still be errors and/or omissions. All online UK orders will be charged in British Pounds Sterling (£) and include Value Added Tax at the current rate but exclude any applicable postage and packaging charges.

Prices on the website are set at different rates for all locations. Prices quoted on the website are indicative only and are subject to change. Prices on the website may differ from those in LK Bennett stores.

English law shall apply to all claims and disputes (whether contractual or non-contractual) arising in relation to or in connection with these Terms & Conditions.

In-store returns policy - full price and outlet stores

If you are not entirely satisfied with your in-store purchase, we are happy to offer a refund or exchange for any full price items or outlet items (as applicable) returned within 28 days of purchase, providing they are returned in their original condition and accompanied by proof of purchase. Proof of purchase is required with every refund or exchange. This is in addition to your statutory rights. Please note that our outlet stores are unable to refund or exchange items purchased online or in full price stores. Please note that our full price stores are unable to refund or exchange items purchased in outlet stores.

Where you buy products via our website as a consumer, you have the legal right (under the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013) to cancel your contract with LK Bennett for the purchase of products within a 14-day cooling off period; without giving any reason and receive a full refund.

This period will expire 14 days after the date that you receive, or a third party (other than any carrier), receives physical possession of the last of your products in your order. This legal right is separate from our returns policy.

Please note that your right to cancel does not apply to: (i) any products or services you purchase in store; (ii) any sealed products which are not suitable for return due to health protection or hygiene reasons, if they become unsealed after delivery; and (iii) any personalised products.

To exercise your right to cancel you must inform us of your decision to cancel this contract by a clear statement, before the cancellation period has expired, including details of the order that you wish to cancel, your name, geographical address, contact details and the date of your notice. For reference, our email is [email protected]. We will communicate an acknowledgement of receipt of such a cancellation without delay. You can also use our return form provided with the delivered products (or request a replacement form by emailing our customer care team).

To exercise your right to cancel you must return the products to us in their original condition and packaging without undue delay and in any event not later than 14 days from the day on which you communicate your cancellation of this contract to us. The deadline is met if you send back the products before this period of 14 days has expired.

You must take reasonable care of the products while they are in your possession. Any returns are made at your own risk. You must pay for any return delivery costs (as may be applicable).

We will reimburse to you (by the same method of payment used to pay for the original purchase) all payments received from you in respect of the products to which the cancellation rights apply. This includes the initial costs of delivery (except for the supplementary costs arising if you chose a type of delivery other than the least expensive type of standard delivery offered by us) without undue delay.

We will also send a confirmatory email to you. Please note that if the value of the products is diminished by any amount as a result of you handling the products beyond what is necessary to establish the nature, characteristics and functioning of the products, we are entitled to deduct that amount from your reimbursement.

If you are not entirely satisfied with your online purchase, we are happy to offer a returns service for any items purchased online that are returned within 28 days of receipt by you, providing they are returned unused in their original, undamaged packaging and accompanied by the return proof of purchase. This is in addition to your statutory rights.

If you made a UK purchase from our website, you can return your item(s) either: (i) by returning to a full price store; this excludes purchases made via Mode, Apple Pay, Alipay or Klarna or (ii) via post to our warehouse. Unfortunately, LK Bennett concessions, outlets and stores outside of the UK are not able to process website returns.

If you made an international purchase from our website, it cannot be returned to our international stores and must be returned via post. Items originally dispatched to the UK but returned from an international address will be subject to our international returns policy.

No one other than a party to this contract has any right to enforce any term of this contract. You may only transfer your rights or your obligations under these Terms & Conditions if we agree in writing.

These Terms & Conditions (including all documents and polices referenced within) together with our current website prices constitute the entire agreement between you and LK Bennett.

These Terms & Conditions cannot be varied except by changes made by LK Bennett or agreed with us in writing. Nothing said by any representative of LK Bennett will operate as a variation to these Terms & Conditions or constitute a legal representation on behalf of them.

The failure of either party to exercise any of its rights under these Terms & Conditions, whether temporary or permanent, shall not be deemed to be a waiver of such rights.
